See the dis - Essay Example What is more important is the content transferred and the copyrights attached to the content. Thus, if there has been a transfer of some content that has been protected by copy right, then this means of file sharing is considered to be illegal. On the other hand, if the content is not protected by copyright, then file sharing may or downloading may not be illegal. Thesis The main reason why unauthorized file sharing is illegal in most countries is that it is considered equitable to theft. Arguments However, sharing or downloading may not always classify as theft. The famous economist and noble prizewinner, F. A. Hayek explains how conventional property rights and copyrights are different in reference to their supply capacities. While it may not be possible for the supply of a material property to be unlimited, it may very likely be that an intangible object has an unlimited supply (Hayek, pp. 23-25). Consequently, because there is an unlimited supply of an intangible asset, accessing that object may not affect the availability of that object to anyone. This implies that theft, where one takes the object of possession away from the owner cannot materialize in case of the intangible asset because the owner would still posses the intangible object. Thus, in essence, unauthorized file transfer is not illegal. Karl Sigfrid, the author of the op-ed submission, who has been arguing in the favor of decriminalizing file sharing and downloading, has also argued along similar lines to support his stance. Another strong arguments that have often being used to support the imposition on copyrights and thus, to make file transfers illegal is that of the potential loss that the owner of the file or the programme might have when his files are transferred to people. Take the instance of a music composer who is at loss when his music files are transferred to others. However, at a closer look the transfer of such files does not bring about any loss to the owner because in the end the owner still has an access to his files at the same time when others do (Lemely, pp. 30-34). More importantly, many artists, musicians, and composer have noted how file sharing benefits them by providing a forum for displaying and publicizing their work. Despite these arguments, the practice of file transfer and downloading is illegal when the file is copyrighted. This is because the owners of the intellectual property (the files that are transferred) state that their intangible property is subject to the same protection as a tangible asset because that intellectual property has some value attached to it. In other words downloading files without the permission of the owner is the same as encroaching on a private property or stealing. Skeptics may argue against this notion by explaining how stealing causes a loss to an individual. On the other hand, the acquisition of the files via file sharing does not add up to the cost of the owner. Nor does it cause any form of a loss of value , so comparing intellectual property with a tangible possession is absurd. However, there needs to be a closer inspection of how the usage of the intellectual property without paying for it is a cost to the owner in terms of the loss of the potential monetary benefits that he/she may have been entitled to receive otherwise. Using that intellectual

Aboriginal Cooking Methods Essay Example for Free

Aboriginal Cooking Methods Essay The traditional ways to cook for aboriginals used to involve roasting their food on hot coals, baking in the ashes steaming in ground ovens. But today theses things have changed the aboriginals have easier ways to cook using technology from today. They have adapted to make the process easier by boiling barbequing. Roasting; When cooking meat, this was the basic technique, which was almost always used. They cooked most meat, fish small turtles. To make sure the meat was cooked through, it was also covered by ashes coals, which also made tough meat softer. The meat would be eaten quickly after roasting. Shellfish were also cooked on the coals on the outside of the fire, this way when they started to froth, they could be removed quickly. Baking Bread damper was cooked in the ashes. When aboriginals made fires, they made sure they used the right kind of firewood, so that after the fire was out, the ashes could be used for cooking their bread. They were very careful as to which wood they used because some woods made to bread taste bad some caused irritation discomfort. Over time, it was the wattle seed that was found to be the most successful for cooking. It gave no bad taste, gave no one irritations produced a fine ash. Witchetty grubs only needed to be quickly rolled over the ashes to be cooked. Then damper was put beneath the ashes then covered. To cook yam, or vegetables, they would dig a small hole, place the vegetable in it, and then cover it with ash. Steaming; In the Wiradjuri areas, steam ovens still exist. The ovens were made by digging a hole in the ground, they were about 90cm long, 60cm deep. The clay left over from digging was then made into smooth lumps then would be placed on top, once the hole was filled with selected firewood. While the wood burned, the clay became hot. The clay would then be removed with tongs. The pit would be swept out then lined with still green leaves grass. Then meat such as possums (because they were small enough) would be lain inside, covered with more leaves then the clay would be placed on top. To stop the steam escaping, the ground that was originally taken out when the hole was dug covers the clay. Wrapping; Wrapping is still used in places like Arnhem Land. Vegetables are wrapped in the moist paper bark from Melaleuca trees then placed in ground ovens. Today Aboriginals use more advanced methods of cooking. They have adapted their old ways to make them easier. Boiling; Aboriginals have now learned to boil foods in galvanized cans, tins, steel drums or whatever items are available. Because of this, ground ovens are being used less less. Barbequing; Although the Aboriginals dont have top of the range barbeques, they have got their own version. It is simply a piece of wire to hole pieces of meat or dough over red coals. Aboriginal Dreaming Although the Dreamtime was in the past, it is the Aborigines religion culture that rules them today. The saying, As it was done in the Dreamtime, so it must be done today, dominates all aspects of the Aboriginals lifestyle actions. According to some Aboriginals, the Rainbow Serpent made the world. It is their belief that that is true. Religion is some peoples way, spiritualism is theirs. The Rainbow Serpent came from the Northern Territory while Australia was still in its dreaming stage. It traveled over the country, creating the mountainous locations by pushing the land into many ranges isolated areas. The Great Dividing Range is a creation of the rainbow serpents movements. Throughout its journey over under the land, it created rivers, valleys, lakes. It was also careful to leave many areas flat. Once it was satisfied with its creation of Australia, spirit people came from inside it moved all over the country to form many different lifestyles, languages different stories. When the land was finally finished, it was ready for people, but there were none .Walya-Nam-Adiki was the woman who walked out of the sea met up with a tribal man. Seen as there were no people, they talked about the problem with having such a wonderful land, but no people to live there. To fix this problem, they had many spirit children together. Walya-Nam-Adiki told all her children to go to all different places across the country to speak new languages, make keep land water management. They were to stay in their chosen areas, to make social kinship systems which would make sure that there would always be people within their tribal boundaries. Other Aboriginals believe that when the world first existed, that giant semi-mortal beings that resembled plants animals rose up from the flat land where they had been sleeping for countless ages. These beings wandered the land aimlessly. As they roamed around, they  performed the tasks that Aboriginals do today. These included camping, making fires, digging for water, fighting each other performing ceremonies. When they became tired of carrying out these rituals, the dreamtime ended. Wherever the creators had been, a natural landform now marks the place. The creators made everything which Aboriginals are in contact with everyday from which they gain their living. Apart from forming the land, they also created the laws that govern the aspects of everyday life, which some Aborigines still live by. Aboriginals in Jail Custody The idea of over-representation of Aboriginal adults in prison is set down early for the younger generation to understand. In Juvenile Detention centers, aboriginals aged 10-17 were 24.2* times more likely to be in custody than non-aboriginal children. For aboriginals aged 18-21 the over-representation rate was 9.6* Indigenous rates of imprisonment in adult prisons varied between about 4* times the non-indigenous rate in Tasmania up to over 20* times in Western South Australia. At almost any time, up to 80% of inmates in Northern Territory Correctional Facilities are of aboriginal descent. Whatever the intent, mandatory sentencing has more effect on aboriginals than any other ethnic group in the NT. Also Police custody rates for Aboriginal Torres Strait Islanders was 26.2* times more likely than people of other races. Aboriginals are 25% of people that are arrested 15% of people who are in jails are also Aboriginal. From data collected, aboriginals are over-represented in offences involving violence, breaking entering, breaches of justice procedures driving offences. Aboriginal people are 12 times more likely than others to be in prison for  homicide and 16 times for breaking and entering. One principle factor is that of the low status of the indigenous side of Australia in socio-economy culture. In 1988, Commissioner Muirhead stated that humanity and our countrys reputation demand a vigorous approach and new initiatives. Years later, Aboriginals still continue to die in police cells prisons. On 10th February, 2000 a 15 yr old boy committed suicide in the Don Dale Correctional Facility in Darwin. He had a mandatory 28jail sentence for petty theft of pens, pencils paint. He was due for his release 4 days after his death. The Northern Territory Chief Minister simply swept aside the death gave a statement There will always be deaths in custody. The death of the boy the Country Liberal Party refused to even consider the re-appeal of the mandatory sentencing laws sent a break of outrage through many leading Australian, International Aboriginal groups. Two weeks previous to the death, a Federal Senate traveled to Darwin, to make a report on the laws. None of the Country Liberal Partys officials was prepared to give evidence at the hearing. The United Nations blasted Australia over these laws, the treatment of the indigenous people to this land. Also saying that Canberra could be in breach of the UN Convention to Eliminate Racial Discrimination. *Based on records in 1998

Essay on Satire in Voltaires Candide -- Candide essays

Use of Satire in Voltaire’s Candide  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚     Ã‚   Voltaire successfully uses satire as a means of conveying his opinions about life.   In his novel, Candide, Voltaire satirizes the philosopher Liebnitz's philosophy that this is the best of all possible worlds.   In the novel, the perpetually optimistic and naive character, Candide, travels around the world, having various experiences that prove, at least to the reader, that evil does exist.      In one particular passage, Voltaire uses explicit diction, exaggerated details and manipulated syntax in order to contrast the optimist's romantic view of battle with the horrible reality that is war. Voltaire's grossly exaggerated details give a somewhat comical description of an otherwise horrible event.   "The cannons battered down about... ...between the ridiculous ideas of the optimist and the truth that only the realist could see.   His choice of syntax leaves the reader with unforgettable images of war that will have a lasting effect.   Through his clever satire, Voltaire urges the reader to be more practical rather than happily ignorant    Work Cited: Voltaire.   Candide.   Trans. Suicide Is Never Painless

Death became an easy option. She wanted to cry, but she had no time. She wanted to change her life, but she didn't believe in miracles. For all the pain and anguish she had carried with her, it suddenly became too much to bear. Life had dealt her the last card but she had no spirit left to play with. The darkness bit into her, memories like poison flowed through her. She fought against them, but as sleep won out she was dragged back to the past. Death became no longer merely an option but a necessity to find peace. The pills lay next to her. They looked beautiful. She knew they could end it for her but she was so afraid. What would be waiting for her on the other side? Was there another side? All she knew was once she had gone that far, there would be no return. She sat there sobbing quietly, her mind tormenting her. She struggled to make sense of herself. The pain that was once emotional was now purely physical and nothing could heal it. The raw, open wounds would remain as fresh as the day they were created. Everything she had fought so hard to forget tore into her like daggers, dancing across her skin, drawing blood in a tide of crimson that stained any happiness she once had. It was tearing her apart. She cradled the pills in her hands, like precious diamonds. With a breath of courage, she threw the pills down her neck. They fell down her throat with ease, headed towards the emptiness of her own hell. She slowly sank down onto the floor, her head rolling sideways uncontrollably. Her mind started to fog over, numbing all her senses. The baby's cries began to recede as she lay almost motionless on the cold floor. She cried out in pain, the distant sound of her own voice pierced her fragile mind. Her life force once a blaze of colours is now black reflecting her feelings of confusion. She is lost yet yearning to be found. She is drowning in the darkness, helpless as it slowly devours her, playing with her mind until there is nothing left but a shadow of someone who was once whole She wasn't alive anymore, she simply existed. She still looked the same, but she wasn't and never would be. A man who had taken everything from her, her innocence, her virginity and now her life, she never even saw his face. She was left to bring up a child sired by a monster. A child conceived out of hate. Was it not enough that she had to be reminded of it everyday? Every time she woke up in the morning, every time she closed her eyes†¦What was the need of his sinister actions? Was it that he didn't understand the word â€Å"no†? Didn't he realise the screams were out of pure terror; that kicking profusely were signals to stop; that the look on her face was of complete despair and frustration; that the touch of his hand made her blood run cold; that he was stealing her dignity, her pride, her self respect?! She made that same journey home every evening like clockwork; she'd been there a thousand times. She turned away from the buildings, away from the street light and her hollow footsteps were the only sounds that followed her†¦Her heart started to pound faster as she tried to gain vision in the pitch black that she had descended into. Her body felt like it was being mauled and still the real horrors had not begun. Dependant on her hearing as her main working sense, she could hear his approach. His curses screamed of anger at her venerable position, his threats called out like promises, nurturing the fear that grew in her stomach. Gagged and bound, her legs flew from under her as she was thrown to the ground. Mud and dirt covered her like a second skin and fell for what seemed to be an eternity, while above; she could still hear him. The sound of him as he forced torture after torture on her, the sound of him as he violated her body time and again, while she lay there helplessly, the tears biting at her eyes like acid. The thing that hurt the most was the realisation of what had just happened to her. As she scrambled blindly in the darkness, a maze of dangers that had waited to harm her. The unknown monsters that hid in the depths of the shadows warped her mind.

Essay Midterm Essay

1)The subfields of anthropology seem quite diverse in their specific subjects and methods. Why, then, are they all considered parts of the single discipline of anthropology? What ties them together? Anthropology is an extensive discipline. It is so broad it had to be split into four subfields; Archeology, Biological (Physical), Cultural, and Linguistic anthropology. The definition of anthropology is â€Å"the holistic, scientific study of human kind† (Park, 2014). Parks (2014) states, every anthropologist wants to know why we have a tendency as humans to behave as we do, change constantly, have different cultural behaviors and the ability to constantly evolve. Anthropology answers these questions from the different subfields. â€Å"Archaeology examines our past ways of life through the interpretation of material culture, organic remains, written records, and oral traditions, Biological Anthropology deals with the evolution of the human body, mind and behavior as inferred through study of fossils and comparisons with behavior and anatomy of other primate species, Cultural Anthropology explores the diversity of existing human ways of life, how they work, how they change, and how they interrelate in the modern world and Linguistic Anthropology examines the structure and diversity of language and related human communication systems† (Sanoma State University, 2014). Even though the subfields seem quite diverse they do have similarities that tie them together. According to the American Anthropology Association (2014), â€Å"each subfield applies theories, employs systematic research methodologies, formulates and tests hypotheses, and develops extensive sets of data.† References â€Å"Anthropology: exploring the human in all of us.† (December 12, 2012). to express that names don’t really matter. However, the tragedy of Romeo and Juliet and our everyday lives show that names are the tools we use to create ideas and organize them in our world. It is human nature to attach preconceived notions to our varied experiences. Everything has to have a meaning so people can order it in their reality. Purpose and reason dictate our daily lives. With this precision, Nathaniel Hawthorne structured his novel, The Scarlet Letter. He helps us appreciate his characters’ strengths as well as their weaknesses with symbolic names. In The Scarlet Letter, Hawthorne uses evocative names to portray the characters’ inner self and what they represent in the story. The most significant name belongs to the character Pearl. Hawthorne shows that this name has two meanings, but only one is used to describe the importance of Pearl’s existence. â€Å"For so had Hester called her; not as a name expressive of her aspect, which had nothing of the calm, white, unimpassioned luster that would be indicated by the comparison. But she named the infant ‘Pearl’ as being of great price- purchased with all she had- her mother’s only treasure!†(79). Hawthorne uses Pearl’s name, in this sense, to express that Hester gave all she had for her child. Just as Pearl’s name serves as a doorway to an idea about her character, Hawthorne also displays Roger Chillingworth’s name to have a deeper importance in the story. As his name suggests, Chillingworth is a man deficient in human warmth hence the beginning â€Å"chilling† of his name. This character is shown as a very evil person throughout the novel. â€Å"In a word, old Roger Chillingworth was a striking evidence of a man’s faculty of transforming himself into a devil,†(152). Free Essays on The Scarlet Letter Free Essays on The Scarlet Letter The Scarlet Letter By: Nathaniel Hawthorne The Scarlet Letter has four main characters, Hester Prynne, the woman accused of Adultery, Roger Chillingworth, Hester’s husband from Amsterdam. They are still married and no one knows that they are. Reverend Arthur Dimmesdale, the man who Hester committed the crime with, and Pearl. The story takes place in Boston, where Hester is accused of adultery and has to wear the letter A on her chest. Hester receives her punishment on a Scaffold. The Reverend Dimmesdale asked Hester who the other person was that helped her commit the act of adultery with her. Hester doesn’t reply. As Hester is on the Scaffold, she is holding her child, Pearl. After a while they leave Hester on the Scaffold in the hot sun for more than one hour as part of her punishment. Then they took her to jail where she stayed for more than a year. While Hester and Pearl are there, Chillingworth comes into the picture and pretends that he is a doctor and goes to take care of the women and the child. There, Hester and Chillingworth talk about what happened, and asks her who is the father of this child? Hester would not tell the identity of Pearl’s father. When Hester doesn’t say, Chillingworth makes her promise that she will not tell that he is her long last husband. Hes ter says yes, ! but Chillingworth tells Hester that he will stay and he will find out the name of Pearl’s father. Then he leaves Hester and Pearl. One year later, Hester was released from jail. Hester cannot live in town because of what happened, the town people think that Hester is evil. They don’t want her there; they use Hester as an example of what happens when a person commits a sin in the Puritan life. So now Hester lives in the country where she makes cloths in order to make a living for herself. She shows off the wonderful clothing for Pearl. Pearl, at the moment, is the only friend Hester has. Later in the story, Hester... Free Essays on The Scarlet Letter The Scarlet Letter By Nathaniel Hawthorne The Scarlet Letter is a story that shows a love that cannot be. â€Å"Mother,† said little Pearl, â€Å"the sunshine does not love you. It runs away and hides itself, because it is afraid of something on your bosom. It will not flee from me, for I wear nothing on my bosom yet!† This quotation is how I see the love that cannot be. The sunshine is the love of a man (Arthur Dimmesdale) and it does just what Pearl says - it runs and hides itself from the scarlet letter. This love must be hidden because of practical reasons; such as Roger Chillingworth who is her husband is still alive. He knows about his wife and Arthur and he is plotting revenge on Arthur. With Roger in Boston he would get in the way of them having an open relationship and he would destroy their true love. Arthur and Hester’s love cannot exist because of personal reasons as well. Hester wears the scarlet letter, so Arthur can’t be with her or it might destroy his reputation. Also, if he were to be with her, the people of his church could not look up to him for their spiritual guidance. The final reason to keep these lovers apart is societal. The Puritan belief in New England during the middle of the seventeenth century would not have tolerated any type of union between Arthur and Hester. The strict codes of conduct would destroy any way for them to be alone. Their only opportunities to be alone are chance encounters in the forest, but then it would seem as if they were going to see the black, mysterious man that represents evil in this book. Because of all these reasons, The Scarlet Letter is a story about a love that could not be. In a more perfect world, Arthur, Hester, and Little Pearl would have left Boston and made a new life for themselves in England. Painfully, this does not happen. However, Arthur does at least proclaim his love for Hester along with claiming Pearl as his child, allowing him to shed his bur... Free Essays on The Scarlet Letter All of Hawthorne’s work is one form or another of â€Å"handling sin†. All of his stories are those of persons whom some crime, or misunderstood virtue, or misfortune, has set by themselves, or in a worse companionship of solitude (Symons 1597). The Scarlet letter, by Nathaniel Hawthorne explores sin and its consequences. The focus of attention is Hester Prynne, Arthur Dimmesdale, and Roger Chillingworth. Each of these characters sin in a unique way. Hester sins by committing adultery. Dimmesdale sins by breaking his vow of chastity, and then hiding his deed. Chillingworth sins by acting upon his desire for revenge, and by torturing Dimmesdale. Hester and Dimmesdale suffer from shame and guilt throughout the novel. It was a sin for which Hester Prynne was damned by society, and for which Arthur Dimmesdale damned himself (Loring 1). Hester is made to publicly acknowledge her sin. A scarlet letter â€Å"A† is permanently placed on her dress to symbolize her adultery, and she is made to stand on the scaffold with her baby for several hours of public humiliation. This is her punishment, the heaviest that man can afflict upon her. Hester is to stand as a warning to others tempted as she was (Hawthorne 13). Hester becomes a social outcast and lives on the outskirts of town. Pearly, her lively and uncontrollable daughter is the daily living proof of her sin. Man had marked this woman’s sin by a scarlet letter, which had such potent and disastrous efficacy that no human sympathy could reach her, save it were sinful like herself. God as a direct consequence of the sin which man had thus punished, had given her a lovely child, whose place was on that same dishonored bosom, to connect her parent forever with the race and descent of mortals, and to be finally a blessed soul in heaven.(Hawthorne 14). Hester is a woman full of motherly love that she showers on Pearl. Hester dresses her daughter with pride and holds her head u... Free Essays on The Scarlet Letter â€Å"What’s in a name? Identify and describe both the time and place of The Scarlet Letter. The time and place of The Scarlet Letter is in, â€Å"†¦the good town of Boston,† Massachusetts, in the year 1850 (105). In the 1850’s people think differently of different things such as crime and life, a simpler time with simple thoughts and people. 1.b. Discuss how the setting contributes to the believability of the novel. In The Scarlet Letter, the setting of Boston is surrounded by a, â€Å"†¦ vast and dismal forest† (68). The story could of taken place in a different place that has bodies of water, a forest, and a town, that is near a peninsula, because the setting doesn’t play a major role in the story except when Hester and Pearl go into the forest, where Hester has a life-turning talk with Mr. Dimmesdale. The forest is like a dark and mysterious place where a dark creature, the â€Å"Black Man,† lives. The time, however, cannot be changed because the story deals with the beliefs of people from the 1850’s. For example people who committed adultery were killed for sinning, even the sinner’s children were killed, but now adultery isn’t punished by death, it usually results in divorce and childcare. 2.a What is Arthur’s objective? How does he go about achieving his objective? What obstacles get in his way? How does he overcome them? In Nathaniel Hawthorne’s The Scarlet Letter Arthur Dimmesdale, and old minister, deals with the pain caused by his sin and dies in the end. Throughout the story Dimmesdale wants to get reed of the pain and misery caused by his sin. He gets reed of the pain by telling everyone about how he sinned with Hester, which takes away the burden on his heart. One major obstacle that gets in Dimmesdale’s way is Roger Chillingworth. Chillinworth tell Dimmesdale that he can help him, but Chillingworth makes the pain last longer. He overcomes his obstacles with... Free Essays on The Scarlet Letter The scarlet letter, a book about a lady named Hester Prynne who lived in the New World, in Puritan Boston. She committed adultery, and gave birth to a child, which was named Pearl. Pearl’s father were not revealed to the public at the time when she was released from prison because Hester decided not to do so, she did not want her child to have an Earthly father but instead she wanted Pearl to have an heavenly father. Hester wanted pearl to be brought up in the normal way of the time of Puritanism. At this time they used strictness and used the rod frequently, but even though Hester at first tried to do her best at this. She quickly realised that Pearl was not going to adapt to her methods so she could not set any restrictions for her. Instead Pearl developed to be a wild child, to her mother and the rest of the Puritan community she seemed to be a little elf and they sometimes doubted that she was human, â€Å" Hester was constrained to rush towards the child,- to pursue the little! elf in the flight which she invariably began,- to snatch her to her bosom, with a close pressure and earnest kisses,†¦, as to assure herself that Pearl was of flesh and blood†¦Ã¢â‚¬ In the beginning Pearl does not show any sincere feelings towards her mother as she changes her mood so often, she seems to be very emotionless and does not show any sorrow, but that is a part of her wild nature. Her way of behaving were seen as an outcome of the adultery that Hester had committed, and now she had to live with a child that did not show any love and was a savage. But Pearl is not completely emotionless she did show emotion when she were walking with her mother on the peninsula, and she were sent to the beach while Hester spoke with the old physician, she stopped throwing pebbles at the seabirds, as she felt sorry: â€Å" But then the elf-child sighed, and gave up her sport; because it grieved her to have done harm to a little being that was as wild as the sea-b... Free Essays on The Scarlet Letter The Scarlet Letter Nathaniel Hawthorne’s The Scarlet Letter is a story about Hester Prynne, a woman who commits a sin. She is crammed with many feelings surrounding that sin such as pride. Her sin is a one of passion. Hester Prynne’s sin is adultery. She commits adultery with the Reverend Dimmesdale. This sin is regarded very seriously by the Puritans and is often punishable by death. The Reverend Dimmesdale is another character that demonstrates the effects of sin. He commits the same offense that Hester commits, adultery. The difference between Dimmesdale and Hester is that Dimmesdale was not publicly punished for his crime. This makes him feel extremely guilty. This feeling of guilt was so atrocious that it mentally and physically withers him, as he feels a very strong need to repent and cleanse his soul. Dimmesdale’s sin is unnoticed. Hester is unable to hide her wrongdoing. Their act of adultery resulted in a child. Her punishment for her crime is to spend a few hours on the scaffold to face public humiliation and wear the letter â€Å"A† on her clothes for the rest of her life. The consequences, which Hester faces, are the result of her admission of guilt. This proved to be much less harsh then the internal punishment that Dimmesdale faced. Dimmesdale’s method of repentance is much worse than Hester’s both emotionally and physically. Dimmesdale whips and beats himself as a form of repentance. Also, he stays up way into the night standing on the scaffold as he struggles to gain the nerve to admit his sin. It also hurts Dimmesdale when the townspeople speak of how righteous and holy he is. All of the internal suffering that he endures proves to be much worse then Hester’s public punishment. Roger Chillingworth is Hester’s husband. He commits a sin against her. He knew that she did not love him but yet still makes her marry him. He also sent her to America while he studies in Amsterd... Free Essays on The Scarlet Letter Hester’s Morality Morality is a term that encompasses many different meanings. Some believe that being dutiful is moral, while others think that being honest is moral. According to Webster’s New World Dictionary, Third College Edition, the definition of moral is â€Å"principles, standards, or habits with respect to right or wrong in conduct,† (â€Å"moral†). Nathaniel Hawthorne utilizes characterization techniques of morality throughout the novel The Scarlet Letter. The qualities that Hester Prynne possesses shape her as a character. Hawthorne represents Hester Prynne as having moral flaws, but in the end she is a good person. (Bloom 22). As Orson Scott Card remarks in Characters and Viewpoints, â€Å"The character story emerges when some part of a character’s role in life becomes unbearable.† (53). This is apparent in The Scarlet Letter because Hester’s life becomes unbearable through her trials as a sinner in the Puritan society. Although the Puritan socie ty believes that Hester Prynne is immoral, the actions that she takes shows that she is actually very moral. Hester shows care towards Pearl, her daughter, which is a clear indication of the kindness in Hester’s heart. â€Å"When the young woman- the mother of this child- stood fully revealed before the crowd, it seemed to be her first impulse to clasp the infant closely to her bosom;† (Hawthorne 50). This is an act of motherly affection, showing that Hester loves her daughter. By abandoning Pearl, Hester’s life would definitely be easier; however, she does not abandon Pearl, because Hester believes that it is morally wrong. Hester’s decision regarding Pearl reveals her high moral principles as a Puritan. By upholding her morals, she keeps her daughter and moves to an isolated cottage away from society. After Hester moves away from the village, the Puritans give her the job of making fine clothing for the upper class. With any extra material that Hester has, she makes ... Free Essays on The Scarlet Letter It has once been said that â€Å"A truly memorable work will illuminate one of the great quests: for love, for truth, for honor, or for justice.† One work of literature that I feel truly does illuminate several of these great quests is The Scarlet Letter by Nathaniel Hawthorne. This work is based in a small, Puritan community where a woman named Hester Prynne dwells. This woman has committed the sin of adultery and is forced to wear a scarlet A upon her bosom to constantly remind her and the rest of the community of her terrible sin. The fruit of this sin however was her little daughter Pearl; a strange, but gentle child. People in the community though, looked at her as an evil, elf-child, born from sin. In the meantime there was a priest named Arthur Dimmesdale who was secretly living in shame; for he was the father to little Pearl. His fatherhood was kept a secret for fear of jeopardizing his priesthood, so Hester took all the blame from the public. Although Hester had to face public humiliation, Mr. Dimmesdale suffered with the symbol of shame burned into his chest never to be revealed, and eating at his conscience. Little to the old priests knowledge, Roger Chillingworth, the doctor who was living at the church with him, turned out to be Hesterâ€⠄¢s ex husband who knew of his sin. The old doctor who had become one of Dimmesdale’s closest and most trusted friends was actually hurting him all along. One day Hester and Dimmesdale met in the woods and decided to run away and start a new life somewhere far away, but not until after his Electorial Sermon. The day came and he gave an incredible sermon which made everyone look at him like a saint, until he made the decision to expose his sin to the community. He called Hester and Pearl upon the platform where he delivered a delivered a dramatic final speech about the pain he went through and how the lord is very forgiving . He then stumbled upon the floor and died in Hester’s arms... Free Essays on The Scarlet Letter Scarlett Letter In the Scarlet Letter, the author uses many different types of symbols to show what he has experienced as a young man, and what he has to say about the society during his time. The different settings of the story are ways in which he describes his environment and how it has treated him as a child. One symbol he uses a lot was the scarlet letter. The scarlet letter takes on different meanings as the course of the story progresses. It also takes on various appearances and symbolism. The letter changes from meaning 3adultery2 into meaning 3able.2 Not only does the letter symbolize Hester1s punishment, but it also serves as different personal meanings to the various characters in the story such as Chillingworth, Dimmesdale, and Pearl to name a few. In the Scarlet Letter, there are many different forms of the letter A , not only that, but the letter A also acquires a variety of meanings. Hawthorne describes the prison as 3the black flower of civilized society2 (p.48) Here he uses the build ings to describe the crime and punishment of his early life. And by using the symbol of a tombstone at the end of the story, he1s probably trying to say that crime and cruel punishment could lead to your death. He also uses the grass plot, saying that it is 3much overgrown with burdock,....and such unsightly vegetation2 (p.48) which symbolizes the things that make people corrupt and why these lead to them being in prison. He also uses the wild rosebush to symbolize 3....sweet moral blossom, that may be found along the track, or relieve the darkening close of a tale of human frailty and sorrow.2 (p.48). The author also gives somewhat of a dim, chill, social, unkind atmosphere to Puritanism. In Chapter 2 he describes by saying 3like a black shadow...grim and grisly...with a sword by his side, and his staff of office in his hand.2 (p.52).The letter A appears in a variety of forms and appearances. It is the elaborately gold-embroidered A on He... Free Essays on The Scarlet Letter The Scarlet letter starts off by telling of the surroundings and bad conditions of the prison. The only decent image of the prison was a rosebush. Hester Prynne was in prison for committing adultery and was to wear the letter â€Å"A† on her dress because of her sin. She was brought in front of the crowd for three hours, so that she could be disgraced for her crime. She began to have flashes of her childhood. She was too proud and beautiful to feel disgrace. Hester was married to a scholar. She came from Europe to Boston about two years ago and her husband was supposed to follow. Instead the Indians held him captive. Part of Hester’s punishment was to confess her partner in sin, but she refuses to. Hester’s husband Chillingworth was also in the crowd. Hester was with her baby who was born in sin. She was sent back to the prison and her nervousness and anxiety attacks were obvious. Her husband was finally brought in as a physician to treat her. It was obvious that their marriage relationship was unemotional and had no sign of love. Her husband wanted her to say who the father of her child was but she refused to tell. He promised he would find him and hurt him if she doesn’t say. Chillingworth made her promise not to tell of their relationship or else he would harm Pearl’s father. They both confessed they had wronged each other. The worst was his age and his derformity and marrying someone much younger. Hester was released from prison . She had a choice to stay where she pleases, but chose to stay around Boston. She lived in seclusion , almost never visiting the outside world. Hester had to wear the scarlet letter for the rest or her life, so she lived in shame and in her mind she remained in prison. She had little work sewing for people. Hester’s daughter Pearl, was very difficult to handle. She never obeyed the rules, and she lived without friends. She was interested in finding out who her ...

The DREAM Act Explained

The DREAM Act Explained The Development, Relief, and Education for Alien Minors Act, also called the DREAM Act, is a bill last introduced into Congress on March 26, 2009. Its purpose is to give undocumented students a chance at becoming permanent residents. The bill provides students with a path to citizenship regardless of the status passed on to them by their undocumented parents. A previous version of the bill states that if a student entered the U.S. five years before the passage of the legislation and was under age 16 when they entered the U.S., they would be eligible for a six-year conditional residency status after completing an associates degree or two years of military service. If at the end of the six-year period the individual has demonstrated good moral character, he or she could then apply for U.S. citizenship. More information about the DREAM Act can be found on the DREAM Act Portal. Why Support the DREAM Act? Here are some of the points supporters of the DREAM Act make to justify it: These young immigrants are blameless for their current predicament. They were brought here at a young age by their parents and had no say in the matter. It makes no sense and is morally wrong to punish them for the offenses of their parents. The government should treat them as victims, not offenders. The country has already made a substantial investment in many of these young immigrants and it would be senseless to throw that away. Most of them have attended public schools. They have earned high school diplomas in the public system. Many have benefited from public healthcare and some from other public assistance. The government could get a return from these investments by allowing them to contribute to the U.S. economy and society. Many have completed high school but cannot attend college because of their undocumented status. Studies show DREAM Act immigrants could provide a powerful boost to the U.S. economy. Many of the typical complaints about immigrants don’t apply to these young people. Most are as American as the native-born citizens around them. They speak English, understand American life and culture, and they are fully assimilated. They tend to be highly motivated and prepared to accept the responsibilities of U.S. citizenship. DREAM Act legislation could transform this lost generation of young people into U.S. taxpayers. Even some conservative Republicans such as former Texas Gov. Rick Perry support the DREAM Act because it would make these immigrants taxpayers who contribute to the economy, instead of people forced to live unproductive lives in the shadows of a nation that won’t acknowledge them. â€Å"Are we going to create a class of tax wasters or are we going to create taxpayers?† Perry said. â€Å"Texas chose the latter. Every state has the freedom to make that decision.†Bringing these young immigrants out of the shadows would enhance national security. As long as the government considers them here illegally, they will not come forward. National security is strengthened when everyone in the country lives openly and contributes to society. To take advantage of the DREAM Act, young immigrants would be required to pass background checks and give their addresses and contact informati on to the government.Giving legal status to these young immigrants through the DREAM Act would not cost the government. In fact, the fees immigration officials could charge applicants could more than cover the administrative costs of running the program. Former President Barack Obama’s deferred action, DREAM Act alternative program already uses fees to cover its costs. Many of the eligible young immigrants are willing to give public service to the country, either through the U.S. military or non-profit enterprises. The DREAM Act could be the catalyst for a wave of service and social activism across the country. Young immigrants are eager to contribute their time and energy to a nation that embraces them. The DREAM Act is in keeping with the United States’ heritage as a nation that treats immigrants fairly and makes special efforts to reach out to young people. American tradition as a sanctuary for exiles dictates that we allow these innocent immigrants a chance to move on with their lives and not cast them as refugees without a homeland.

How to Buy the Best Travel Insurance

How to Buy the Best Travel Insurance SAT / ACT Prep Online Guides and Tips A stolen laptop, a skiing injury, a dangerous hurricane- knock on wood that none of these accidents or emergencies ruin your travels. While you can’t do much to ward off bad luck, you can protect yourself from financial loss by buying a travel insurance plan. The best travel insurance will reimburse money you lose from a cancelled flight, medical issue, stolen belongings, or a number of other accidents that can occur when you travel. You can buy short-term travel insurance to cover a single trip or long-term insurance if you’re moving abroad for a year or more. This guide will go over all the benefits of travel insurance, as well as help you decide whether or not you need to purchase a plan before your trip. If you already know you want a plan, then jump down to my picks for the five best travel insurance plans for 2016. To start, let’s go over what travel insurance plans cover. What Is Travel Insurance? What Does It Cover? There are a variety of travel insurance plans out there, and you can shop around for one that covers what you need and leaves out what you don’t. Most plans insure the following essentials: Medical costs incurred from injuries on your trip (you may have to meet a deductible first, and then the insurance will cover costs beyond it) Trip interruption or cancellation (due to external circumstances, not because you woke up that morning and didn’t feel like flying) Lost or stolen baggage or belongings Emergency evacuation 24-hour emergency assistance Some plans only cover medical costs, and leave out the rest or offer these coverage options as add-ons. Many plans make a 24-hour travel service available to you, and some offer concierge services to help you make reservations. If you’re heading to the Alps to go skiing or Thailand to go rock climbing, then you can also add on coverage for any injuries incurred during adventure activities. Holiday insurance plans cover a wide range of issues, but they draw the line at some expenses. Read on to learn what most travel insurance plans don’t cover. Waiting at baggage claim and your suitcase is nowhere to be seen? Travel insurance can cover the cost of lost luggage. What Does Travel Insurance Not Cover? There are some limitations to travel insurance. If you’re traveling to a country in conflict, for instance, then you won’t find yourself covered there under most plans. Most plans also don’t cover, Elective surgery or treatment Injuries caused by alcohol or drug use War Some holiday insurance plans also don’t cover pre-existing medical insurance or acts of terrorism, or they offer these types of coverage as additional add-ons. When you buy a plan, make sure to read the fine print to see what’s included. If something important is missing, then see if you can add it onto the plan. After you purchase a plan, hopefully, you won't have to interact much more with the travel insurance company. But what if you do fall ill or get your laptop stolen? How exactly will your travel insurance plan cover these costs? How Does Travel Insurance Work? In the majority of cases, your holiday insurance will reimburse you after you file a claim. If an incident occurs, then you should save all receipts or other documentation to submit to the travel insurance company. If you're in need of emergency assistance, then you should call its 24-hour emergency assistance number. Most insurance companies advise you to contact them and submit a claim as soon as you're able after an incident occurs. That way they can process your claim quickly, as well as let you know any additional steps you need to take in the moment. While travel insurance reduces the financial risks of a trip, it isn’t necessary for all travelers. When should you take steps to insure your travels, and when would you be fine doing without? Make sure to keep all your receipts in case you need to file a claim. Do You Need Travel Insurance? Whether or not it makes sense for you to insure your trip depends on a number of factors. I’ve gone on a bunch of international trips and have only purchased travel insurance once. I insured a multi-month trip where I was backpacking around developing countries and wanted to be covered in case of injury or illness. If you’re not sure whether or not you need to buy travel insurance, consider these next four questions. #1: How Much Will Your Trip Cost? Are you investing a significant amount of money in your trip, or are you taking a short discount flight and crashing on your friend’s couch? If the former, then you might want to protect yourself with trip cancellation or interruption insurance so you don’t face a big financial loss. Look for coverage that will reimburse your flight, hotel, and any other pre-booked reservations. If you’re going on a relatively short, inexpensive trip, then you probably don’t need travel insurance to protect your investment. This doesn’t necessarily mean you don’t want your medical costs to be covered, but you likely don’t need insurance that covers trip cancellation or interruption. #2: Are You Already Covered? Before you start picking out a plan, check to see whether any of your existing policies- health insurance, car insurance, credit card agreements- cover any travel risks. Your regular health insurance, for instance, might reimburse you for medical expenses that you incur while abroad. Certain countries, furthermore, may offer free or low-cost healthcare to visitors. If you’re renting a car during your travels, then your regular car insurance or even credit card might cover rental insurance (except in Israel and Ireland, the latter of which I found out on a recent trip to the Ring of Kerry). Furthermore, some credit cards will also reimburse lost luggage or a cancelled flight. As you start to think about insurance, check out any existing policies you have to see if any aspects of your travels are already covered. Some car insurance and credit card policies cover the cost of rental cars in other countries. #3: Are You Worried About Emergency Evacuation? If you’re traveling to a country with volatile conditions, whether they be political or climate-related, then you might want to make sure you’re covered in the event of emergency evacuation. While you’ll likely have to choose a plan that’s a step above the basic one, you can get covered for emergency evacuation, as well as any loss or injury due to natural disasters or terror attacks. If it looks like a storm is brewing, then you may want to take coverage. #4: How Concerned Are You? Finally, the decision about whether or not to buy travel insurance may largely come down to peace of mind. If you’re really worried about the risks of your trip, then the additional cost of holiday insurance could be worth it to clear your mind and allow you to enjoy your trip. If you end up at the conclusion that you do need travel insurance, which plan is best for you? The following are some of the main coverage options to look for when choosing your best travel insurance. Traveling during a stormy time of year? Some insurance plans cover cancellations or delays due to weather. What Should You Look for In a Travel Insurance Plan? Most travel insurance companies provide plans at a few different levels, from the most basic to the deluxe, as well as optional add-ons to cover specific medical concerns or activities. Below are some essential features that most plans cover. Consider if any or all of these categories are important to you as you decide which travel insurance is right for you. The four main categories are trip cancellations and interruptions, medical and personal issues, overall cost, and miscellaneous personal needs. #1: Trip Cancellations and Interruptions Trips might get cancelled or interrupted by weather, employment transfer, jury duty, natural disaster, passport or visa theft, pregnancy, pre-existing medical condition, sickness, injury or death of traveler or a loved one, terrorist attack, traffic accident en route, or work reasons. Basic plans tend to cover cancellation due to weather or natural disaster, while pricier plans will cover a pre-existing medical condition or employment transfer. Typically, only the most comprehensive plans cover â€Å"cancellation for any reason.† You might also look to see if your plan covers delayed, lost, stolen, or damaged luggage, as well as the cost to replace a lost or stolen passport or visa. #2: Medical Issues These issues could include medical or dental emergencies, hospital visits, prescribed drugs, ambulance services, 24-hour medical assistance, and return of remains. Some plans may also cover pre-existing medical conditions. #3: Miscellaneous Personal Needs Look to see whether your particular needs are covered, whether you want to make sure you’re covered in case of bungee jumping incident or that your kids are covered for free under the plan. These miscellaneous needs largely depend on the length and nature of your trip. If you're planning two weeks of bungee jumping, rock climbing, parasailing, and whitewater rafting, then you might want to add on coverage for adventure activities. #4: Overall Cost Finally, a major last consideration is how much you want to pay for travel insurance and how much the company will dish out. Some companies insure a trip up to $10,000, while others cover trip expenses up to $100,000. You should also look at medical deductibles, or at how much you’ll have to pay out of pocket before the insurance company will start to reimburse doctor visits and other medical costs. Cheap travel insurance plans tend to cover just one or the other when it comes to medical and travel insurance. You might be able to find medical travel insurance for only about $30 for a two-week trip. Plans with more perks may range anywhere from $100 to $400 for a month-long trip abroad. With these factors in mind, I picked out the five best travel insurance plans. Read on to see options that provide comprehensive coverage, competitive rates, medical support, and coverage for older travelers and expats. The 5 Best Travel Insurance Plans Taking the above factors into account, I looked at different travel insurance companies and compared the extent of coverage, the potential for plan customization, and the overall cost to choose the best plans. If you want to compare travel insurance on your own, you can also check out the travel insurance search engines, InsureMyTrip and SquareMouth. These travel insurance comparison sites are superior to a travel or booking agency, which could have partnerships or gain commissions for pushing certain policies. Read on for the best travel insurance companies for 2016 and what makes them stand out from the pack. Below, you’ll find some more advice on how to buy a travel insurance plan to cover your trip. #1: Travelex Insurance Services- Best for Overall Coverage Travelex rose to the top of the pack for its wide range of customizable options for both leisure and business travels. It has three plan levels- basic, select, and max, all of which cover 100% of your trip’s cost in the case of cancellation or interruption. The select and max plans, actually, cover 150%, meaning you’ll get additional money back! The plans also cover up to $100,000 in medical costs. Travelex insurance covers children under the age of 21 for free. It also has add-on options for adventure activities, like rock climbing or parasailing. The basic Travelex plan does not cover pre-existing medical conditions, so you’d need to choose the Select or Max plan if you want that coverage. Overall, Travelex is a good choice if you’re covering a relatively pricey, international trip. The downside is that you can’t cover trips that are longer than 180 days. I also found the website to be kind of clunky; you need to fill in all of your personal and trip details before you can get an initial quote. Make sure your travel insurance plan includes everything you need, like lost luggage reimbursement or emergency medical helicopters. #2: HTH Travel Insurance- Best for Medical Coverage If your main concern is medical coverage, then you should check out HTH travel insurance. It allows you to buy travel medical insurance without any other add-ons. If you do go with HTH, you’ll have access to a useful app that locates English-speaking doctors close to you and helps you book appointments. Depending on your plan, you can get coverage for anywhere from $50,000 to $1 million in medical. The plans can cover an unlimited number of trips within a 12-month period, and some even let you keep the health coverage for nine months after your trip ends. There are a variety of plans for individuals, students, groups, and expats living abroad. There are a couple downsides to HTH insurance plans. One is that they don’t cover injuries from adventure sports and other activities. The second is that you might have to have a primary health care plan in order to purchase some of the HTH plans. HTH is a good choice for medical insurance abroad, but it unfortunately falls short if you’re an adventure sports enthusiast. #3: World Nomads- Best for Budget and Adventure Travelers While HTH doesn’t cover adventure sports, World Nomads has add-on coverage to cover over 200 of them! It’s a popular company for adventurous travelers, backpackers, and anyone traveling on a budget. I used World Nomads on my multi-month trip and found that it had relatively cheap holiday insurance plans with great coverage options. Plus, the website is streamlined and easy to use, and you can sign up anytime before or even during your travels. World Nomads plans cover trip cancellation or interruption, medical care, emergency evacuation, and lost or stolen gear. They insure your trip for up to $10,000, lost or stolen baggage for up to $3,000, and medical costs for up to $100,000. Since World Nomads sets a limit on trip cancellation at $10,000, it’s not the best choice for luxury travelers. Another downside? It doesn’t offer plans for groups or travelers over the age of 70. If you're going on a long-term international trip, then you should probably get insurance, just in case. #4: TravelSafe Insurance- Best for Long-Term International Trips If you’re traveling internationally and would like reservation or language assistance while abroad, then TravelSafe is a good option. It offers 24-hour travel assistance services, including concierge and interpreters. TravelSafe will insure trips for up to three years, so you can buy annual travel insurance plans. You’ll get up to $2,500 coverage of a lost or stolen passport or a missed flight or other connection. TravelSafe has a variety of individual and group plans at three levels, silver, gold, and platinum. The platinum plan offers a â€Å"cancel for any reason† benefit, which will refund 75% of your trip. #5: Allianz Global Insurance- Best for Older Travelers While several travel insurance companies set an age limit, Allianz doesn’t impose one. It’s also relatively inexpensive compared to a lot of other companies. Allianz offers a variety of coverage options and will insure trips that cost up to $100,000 (a much larger sum than the $10,000 covered by World Nomads). You can buy a short-term or annual plan, and children under the age of 17 are covered for free. Allianz has an app that will help you find nearby English-speaking emergency services in most countries. It doesn’t offer concierge services to help you with reservations, though, nor does it cover the cost of a lost or stolen passport. Allianz is a good option for older travelers, plus it’s a relatively affordable choice for those looking to insure an expensive trip. Once you find the comprehensive or cheap travel insurance plan that best meets your needs, what do you do next? What steps do you need to take to purchase travel insurance? Purchasing travel insurance is easy! Just go online. How to Buy a Travel Insurance Plan Once you’ve done a travel insurance comparison, thought about your needs, and chosen the best travel insurance for you, you can take steps to purchase a plan with an online application. You can buy your insurance directly from the company’s website or from a travel insurance compare search engine, like InsureMyTrip. You’ll need to know the dates of your trip, as well as your passport number. You’ll also fill in general personal information, your country of origin and destination, and ultimately, your payment details. Once you submit, you should get a confirmation email of your plan purchase immediately, as well as supporting documents sent via email or mail within a few days or weeks. Most travel insurance companies want you to purchase your plan prior to departing on your trip. Ideally, you should buy a plan immediately after you make your first deposit (usually the flight purchase). If you decide you want to buy additional add-ons, like a â€Å"cancel for any reason† option, then you’ll probably need to take care of it at least two weeks before you leave. World Nomads is unique because it lets you purchase a plan even after you’ve already left, and you can extend it any time if your plans change and you decide to enjoy your international vacation for a few weeks or months longer. Again, once you buy your plan, you’ll receive your insurance ID and policy through email or mail. Ideally, you'll never have to communicate with the travel insurance company after you buy your plan! Finding the Best Travel Insurance: Final Thoughts Ideally, you’ll never actually need to use the benefits of your travel insurance because your trip will go off without a hitch. Knowing that the benefits are there, though, can give you peace of mind, as well as provide serious financial protection should any unforeseen emergencies occur. Before buying a travel insurance plan, make sure to consider your needs and reasons for buying insurance. If it makes sense to insure your trip, then search around for the best rates and the coverage that protects you in the ways you need, whether you need medical coverage or just want to insure your electronics or extreme whitewater rafting trip. Again, the most common considerations for people when they buy travel insurance are injury or illness, trip cancellation or interruption, lost or stolen belongings, 24 hour services, and other issues in the destination country that could call for an emergency evacuation. Whether you’re a luxury traveler, backpacking through Southeast Asia, going on a family trip, or moving to another country, you will be able to find a travel insurance plan that specifically meets your needs as a traveler.

Letters of credit have been described as the lifeblood of Essay

Letters of credit have been described as the lifeblood of international commerce. (Kerr LJ in RD Harbottle (Mercantil) Ltd v N - Essay Example The slightest delay can lead to huge loss due to exchange fluctuations during the period delay. There are instances of huge losses in the international trade by way of exchange fluctuations alone. This paper will examine the indispensability of the instrument so as to be called the life-blood of international commerce In RD Harbottle (Mercantil) Ltd v National Westminster Bank Ltd,2 the court has emphatically stated that there should not be the least interference of the courts in the letter of credit transactions as it is indispensable for the smooth flow of international commerce. Except in cases of frauds of which banks have notice, the irrevocable obligations under a letter of credit cannot be undone by the parties for reasons of any dispute between them. Court are not concerned with their difficulties however great they may be as they can always settle their disputes in a different forum without disturbing the operation of letter of credit which is a banking system at a different level. This is the essence of the court’s ruling in the above case. ... The issuing bank has just to make sure the documents submitted by the beneficiary are in strict compliance of the credit terms and nothing more. In view of this, neither the applicant (buyer) nor the beneficiary (seller) can frustrate the letter of credit payment under some pretext or other. It is because the credit is a stand -alone document like a legal tender 3 and its validity cannot be questioned lest the international commerce will lose confidence in the system with the resultant collapse of the international trade. This, Donaldson LJ characterizes as ‘thrombosis will occur if , unless fraud is involved, courts intervene and thereby disturb the mercantile practice of treating rights thereunder [of letter of credit] as being equivalent to cash in hand’4 (foot note 5 begins) Further, letter of credit is part of commercial law to facilitate commerce. The rules must therefore be consistently followed by the courts without giving way to the idiosyncrasies of individuals though courts’ view of the will change overtime. Only then, outcome of a dispute can be predicted with a law that is clear and consistent so that litigation is avoided. If it is unavoidable, it should be quickly resolved especially in a price/exchange fluctuation market. The court’s approach in RD Harbottle is to ensure certainty for documentary credit which is an assurance from bank for payment against presentation of documents. Though the term UCP needs to be incorporated in a documentary credit contract, courts have the liberty to view it as impliedly incorporated even in the absence of the express provision of the UCP.5 Therefore principles such as doctrine of strict compliance, party’s autonomy and fraud

SWOT Analysis of High-End Consignment Clothing Store Essay

SWOT Analysis of High-End Consignment Clothing Store - Essay Example Consignment stores are managed in a way that both the consignee and the consignor are in the queue to make some money. As per the rule book a consignor has the right to scrap the partnership if it feels the business is moving at a tortoise pace and can take its goods back from the consignee as the deal is for a limited period of time between the two (Andre, 2004, p. 218-219). 2 - Essay Example This discussion explains how they American Patriots won the Revolutionary War. American colonies won the Revolutionary War through the use of various strategies that disadvantaged its enemies. It is necessary to explain that a good war is fought by an army that is located near its home. America fought a war that took place on its major colonies and thus it was very easy for military orders, troops and supplies to reach their destination without delay. On the other hand, the British colonized a very expansive region and this means that there were challenges in transporting troops and other military supplies to soldiers. The distance covered by British troops was longer and cumbersome compared to the one covered by American troops. Therefore, geographical barriers became a huge hindrance to the British Empire and this put their troops at a disadvantage (Zinn 55). On the other hand, it was very easy for American troops to be organized and get military supplies and new recruits within a short time. Secondly, Americans had clear objectives that motivated its troops to fight and ensure they were achieved. In addition, Americans supported their troops to help them have adequate supplies that would enable them to fight without being in a disadvantaged position. It is necessary to explain that Americans believed that no country had a right to invade its territory and command its citizens. Therefore, they fought to reject violation of their rights and ensure they were allowed to do what they wanted without restrictions. In addition, America had been colonized by the British for a long time and it was time to become self-governed. One of their main objectives of waging war with Britain was to eliminate the British rule and become independent. It was not easy to become independent without engaging in bloodshed. On the other hand, the British had no

Education Business Partnership Essay Example | Topics and Well Written Essays - 5000 words

Education Business Partnership - Essay Example Schools on the other hand supported the initiative unanimously. At the time of the bid, Newham was the most deprived local authority in England, and deprivation in three of the wards in the zone was worse than elsewhere in the Borough. Consequently the aim of this paper is to assess the effectiveness of partnership and the quality and impact on education in Newham. Burke J (1995) By establishing a strong working relationship with a wide range of partners. The business partners are committed to improving education in the area and also making a vital contribution to the zone's work. Schools are frequently working in clusters and as a result head teachers and governors are increasingly responsible for deciding how the zone's resources should be used. This has led to an increase in the number of initiatives, despite justifiable complaints from teachers that there are already too many. Although communications between clusters are not as good as they should be, attainment is improving at a better rate than elsewhere in the country, even if results remain well below national averages in external examinations for 16-year-olds. This improvement is, in part, the result of zone initiatives. Buss D (1995) Attendance is now close to the national average in primary schools and teachers are confident about the improvement in behavior that has been achieved substantially by the zone initiatives. At the secondary school attendance is improving, even among pupils with a history of persistent absenteeism. Green away D & Tuck J (undated) Professional development includes training in lesson observation, and this is improving the quality of teaching and learning in general. Attainment in ICT has improved because teachers are better trained and pupils have access to more and better equipment. At first the activities to promote social inclusion were unsuccessful but the new arrangements are having more impact. Modest expenditure on the arts has raised standards and improved pupils' attitudes to education. Zone support for its one secondary school has been substantial and helped move it out of special measures. Buss D (1995) Increased Enrolment Over recent years there has been a significant change in the population of the area, with a growth in the number of families of minority ethnic background and of refugees and asylum-seekers. One zone school, for example, has over 60 languages represented. At the same time there has been substantial regeneration, including a new exhibition centre and housing redevelopment, bringing with it a mix of residents. From the outset the zone included two nurseries, one infant, 16 primary, and one secondary school. Three of the primaries are church schools. A new primary school, Britannia Village, was added in June 2000, shortly after it opened. Burke J (1995 At the time of the bid three of the primary schools and the secondary school were in special measures and one primary school was judged by its inspection to have serious weaknesses. At the time of the inspection three different schools were in special measures and four had been judged to have serious weaknesses. When the zone started, attainment in its schools was below the national average but broadly in line with those in other LEA schools for pupils aged seven. At ages 11, 14 and 16 attainment was

Relationship Between Food And Art English Language Essay

Relationship Between Food And Art English Language Essay This essay will examine the relationship between food and art by asking if food can be thought as an artwork, and if so, the commonalities it shares with other art pieces. To discuss the feasibility of the aforementioned relationship, this essay will use a particular example, through which different theories will be analysed. However, it is important to put forth this essays hypothesis, which agrees that food can be thought as an art piece, a concept which will be discussed later on. Our example concerns the figure of the Catalan cook Ferran Adrià  , who had the best restaurant in the world, El Bulli, for five years, with the added accolade of three Michelin stars until 2011, when it closed. The reason why this case has been chosen has to do with the fact that Ferran Adrià   has been compared as an artist and his dishes as unique artworks by different experts in gastronomy. FOOD AS AN ARTWORK In order to analyse if this connection is feasible, it is important to discuss the notion of food and its role in the society, an aspect that can be easily linked to the idea of artwork. Different authors have discussed the social function of food in the society. For instance, J. Hegarty(2001) says that one of the principal differences between animals and humans is the fact that we cook our aliments, which causes cultural differences among humans. Moreover, he also argues that cooking is something that humans learn and, therefore, it is not an innate characteristic but an idea that can be related to the dichotomy between nature and culture, discussed by different classic anthropologists, such as Claude Là ©vi-Strauss. Since food is one of the aspects that differentiate humans from animals and the notion that cooking is an acquired skill, it does belong to the culture. This is enough to conclude that food has an impact in the society. However, there are other reasons why, such as tho se discussed by O. Castillo and E. Gonzà ¡lez(2007), who purport that during the process of eating, human beings are also looking for other social elements, as establishing new friendships or partnerships. All these ideas discussed by these scholars can be applied in different societies and in specific social contexts, which will help to understand the importance of food within it. For instance, in the case of the birthday of a family member, all the family will meet up and have a meal together, normally lunch or dinner. In this case, the idea of meeting up to eat is used as an excuse to gather together all the family. This is only a particular social context that can be used to exemplify this connection between food and its role in the society as a process that goes beyond the simple fact of eating. So far it can be seen that food has a function in the society, which is a considerable aspect in order to link it with an artwork. As this module has shown throughout the term is that art pieces have social meaning and they structure a part of the society. One example could be the Bark Paintings, a type of Australian Aboriginal art, which are a re-representation of the landscape. Mainly, these form a representation of the external memory recalling clues of the ancestral intention, which is encoded in the landscape, linking emotional ties with the land and the presence of the ancestors in it. Another example could be the basketry by the Yekuana, which is used to structure the society in a particular way; as Guss says, Basketry therefore becomes a significant indicator in the general growth and competence of an individual, used to chart not only practical knowledge but also status and identity(2006:380). Whit both examples it has been shown how art also has a role in the society influe ncing different aspects of such. In the case of El Bulli, this idea that food goes beyond the simple fact of eating is also represented mainly attributed to two reasons. Firstly it can be thought that because of the high prices (minimum 400à ¢Ã¢â‚¬Å¡Ã‚ ¬/person) the people that decided to go there expected something more than just the food. Secondly, the fact that the waiting list was minimum two years it is another element that shows that the costumers looked for something else than just food but all the experience that goes with it. Some scholars have argued that food cannot be considered art because of its inherent and basic function: consumption. Before discussing this question, it is important to talk about the concept of aesthetic reactions, which in the words of Hegarty(2001), it is related to the idea of beauty, and specifically in the case of gastronomy: This translates into menu balance and harmony in such areas as colour, temperature, taste and texture which in some cases can be dictated by the aesthetic demands of the raw materials which are used to create a gastronomic work(2001:12) From this quote it can be said that if a specific dish has the characteristics mentioned, then it would be thought as beautiful and therefore as art. This idea of aesthetic reactions is also discussed by Tefler, who says that the aesthetic qualities can be characterised as non-neutral, non-instrumental, having certain intensity and often accompanied by judgements for which the judgers claim a kind of objectivity(2002:11). In other words, for Tefler an object has an aesthetic reaction if it is appreciated for its own characteristics, it can impress the viewer and it is not influenced by a personal criterion. In El Bullis case of study the idea of aesthetic reactions is useful because it is one of the characteristics associated with art. Aside from the different opinions of it, it can be said that the notion of aesthetic reactions is mainly related with the idea of beauty, and also to the different characteristics given by Tefler. Regarding this example, it can be seen that some of the dishes do not look as food at first sight but they can be thought as a portrait or as an artistic photograph  [1]  . Moreover, if the Hegarty point of view is taken into account, the harmony of Ferran Adrià  s dishes can be related to the idea of beauty and then to the concept of aesthetic reactions, which is a key concept for the art pieces. However, some scholars believe that food cannot be thought as art because of its function, such as M.L.Quinet(1981), who has the argument that the function of art is to provide an object for aesthetic contemplations and, on the other hand, the foods function is its consumption, which causes that these two concepts cannot be associated. However, she also states that in some cases food can be considered art as long as it has an aesthetic function and it is not expected to be eaten. This idea is relevant to demonstrate that what makes this discussion so complex is the main function of the food. But even if the purposes between them are different, it does not have to be the only criterion to conclude that food is not art. The Quinets idea is helpful because it introduces a key difference between the arts function, an idea discussed later on. Finally, it is relevant to discuss Teflers idea that not all objects with aesthetic reactions can be considered artwork, because they do not share the characteristics of what constitutes an art piece, a point I will endeavour to explore next. An artwork is by Tefler a man-made thing, even if the human involvement need consist of no more than putting a natural object in a gallery and giving it a title(2002:12). She differentiates between artwork which can be seen in a classificative or evaluative manner. In general terms, an artwork in the classificative sense has to do with how the object is regarded and if it is intended for an aesthetic consideration. On the other hand, an artwork in the evaluative way deals with the idea if the object deserves the merit of being considered as such. This difference in the meaning of an artwork is useful in terms of knowing that the concept of art cannot be thought as a static one with only one meaning. In regard to food this categorisation is also useful, because as Tefler says, food can be thought as art in the classifying way of artwork, since for many cooks and costumers some meals are intended to be considered in an aesthetic consideration, in other words, to be savoured, appraised, thought about, discussed(2002:14). So, the main point of those meals is not to provide nourishment but to have a further experience. This idea of food as an artwork in a classifying sense can be highly related with Ferran Adrià  s work, which requires a lot of thought and analysis before cooking it, and its aim is to provide an unforgettable experience to the customer, which goes beyond the simple fact of eating. In relation to this classification of artworks it is also important to mention the difference between art and craft, which is argued by various scholars. Quinet, who thinks that food cannot be considered art in general terms, concludes that The culinary arts, one might claim, are indeed arts, but only when we use the term art in the sense of mere craft; and this is not the way in which the term is used in aesthetics(1981:159). The difference between art and craft is also analysed by Tefler, who says that it lies in the degree of creativity, so something is considered art if it is an original creation and when the object is a result of carrying out instructions then it is contemplated as craft. The relationship between this classification and food is significant, because depending on the level of creativity in the process of cooking, food could be thought as art or not. Even if in general terms a receipt is being followed when cooking, in the case of El Bulli, the creativity applied i n their dishes is enormous, because there is a long process of analysis behind with the goal to create new imaginative dishes. One example of such could be the dish called Peach paper  [2]  , which is presented as a letter or also the liquid olives  [3]  , which is the result of a complex molecular technique created by Ferran Adrià   named spherification. Hence, the food cooked in El Bulli can be considered an art according to the amount of creativity. In relation to this difference between art and craft it is also advantageous to mention the classification between fine and useful arts, argued by Hegarty. The useful arts are those that are utilitarian, such as the design of a building or furniture. However, fine arts are defined by seeking to relate, to communicate and commune between people in that, the artist assumes an audience when he/she for example, writes a poem or paints a picture(2001:8). Food can be related to this last idea of fine art, as well as theatre, music or dance(Anson,2006), an idea that can also be known as minor art. CONCLUSION This essay has discussed the idea that food can be considered as art by using a specific case of study, El Bulli. Different arguments have been put forth to demonstrate the existence of this connection between art and food, such as its social role in the society as well as other artworks. Concerning the case of study of this essay, it can be said that El Bullis dishes can be related to the idea of artwork. One reason is their aesthetic reactions, meaning that they are associated with the concept of beauty, causing the difficulty to differentiate some of them from portraits. Another reason is because their function goes beyond the idea of nourishment, since they are expected to provide a further experience. Furthermore, they have a high degree of creativity, which makes it possible to correlate them with the idea of art and differentiate them from the notion of craft. appendix http://www.elbulli.com/catalogo/commons/generar_img.php?id=879PoG=G Picture 1.1: Soup of pink grapefruit with tarragon and praline salted with black sesame (2003) http://www.elbulli.com/catalogo/commons/generar_img.php?id=987PoG=G Picture 1.2: Blooming cucumbers in vinegar with mustard seeds and tarragon (2004) http://www.elbulli.com/catalogo/commons/generar_img.php?id=920PoG=G Picture 1.3: 2m of Parmesan spaghetti (2003) http://www.elbulli.com/catalogo/commons/generar_img.php?id=1207PoG=G Picture 1.4: Tree passion fruit (2005) Picture 1.5:http://www.elbulli.com/catalogo/commons/generar_img.php?id=973PoG=G Ties of beet with vinegar powder (2004) http://www.elbulli.com/catalogo/commons/generar_img.php?id=1098PoG=G Picture 1.6: Paper of peach Tramontana (2005) http://www.elbulli.com/catalogo/commons/generar_img.php?id=1095PoG=G Picture 1.7: Spherical green olives- I (2005) Liquid olives http://www.elbulli.com/catalogo/commons/generar_img.php?id=1085PoG=G Picture 1.8: Bicolour wafers of carrot and beet (2004)
